SHIVAI INC. ("SHIVAI") has created this statement in order to demonstrate our firm commitment to protecting your privacy. The following discloses our information gathering and dissemination practices for this website. As this policy may change from time to time, please check back periodically.

SHIVAI is a WORLDWIDE ONLINE MALL AND AUCTION platform. Our goal is to provide and website to be used by registered users to list items for selling or list services. Buyers may opt to go to our SHIVAI GLOBAL MALL or SHIVAI AUCTION. Buyers may bid or opt to make “BUY NOW” purchases instantly, securing their chosen items. Payment arrangements may vary depending on the method of purchase, merchant agreements, and buyer preferences. Final fees and postage may also be organized via SHIVAI.COM website. However respect will be given to shipping charges as required by each merchant based on mode of shipment, weight, location, etc.
 
Solely to enable SHIVAI.COM to use Your Information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicenseable (through multiple tiers) right to exercise the copyright and publicity rights (but no other rights) you have in Your Information, in any media now known or not currently known, with respect to Your Information. SHIVAI.COM will only use Your Information in transaction E-mails.

SHIVAI uses the information we collect about you to process orders. When you register at SHIVAI, we collect your name, E-mail addresses, mailing address, credit card number, and expiration date in order to process and fulfill your order. Your information upon ordering will become available to the merchant or vendor utilized. You address and other information may then become available to the SHIVAI listed merchant or vendor for concluding the sale and processing your order(s) to allow correct shipping of items.

When you sign up for SHIVAI Auction Alerts, we need only an E-mail address to send you the E-mail topics that you have selected. We also use your E-mail address to send you E-mail notice of your bid and order status, and we may use your E-mail address to send you notice of upgrades or changes to SHIVAI, new services, and special offers. You may choose not to receive any of these E-mails when you register, or at a later date, by accessing SHIVAI Auction Alerts.

COLLECTING INFO

SHIVAI is the sole owner of the information collected on http://www.shivai.com. We collect information from our users at several different points on our Web site.

We occasionally will ask for additional information from you. For instance, we may ask for your name, address, and E-mail address in connection with a contest or other promotional feature in which you participate, so we can administer the contest and notify winners. We may offer contests or promotions with third parties; policies concerning use of your personal data gathered in connection with any such contest or promotion will be specifically set forth in the rules and policies applicable to the contest or promotion. You may opt-out of participating in any contests offered..

When you bid on an item, you must enter the amount of your bid, your SHIVAI Login ID and your password. Only your username will be publicly available in the Current Winning Bids history.

Recognizing the global nature of the Internet, you agree to comply with all applicable local laws and rules regarding online conduct and privacy, as well as content. Specifically, but not as a limitation, you agree to comply with all applicable laws regarding transmission of technical and personal data exported from the United States or the country in which you reside.

Cookies
"Cookies" are pieces of information that are passed to your browser and stored on your computer's hard drive. SHIVAI uses cookies to recognize repeat visitors, to automatically enter your login ID in our bid form, and to provide additional features to make bidding & buying at SHIVAI easier and more efficient. If you do not wish to receive cookies, you can turn them off using your browser's settings . We do not link the information we store in cookies to any personally identifiable information you submit while on our site. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the users hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. By setting a cookie on our site, users would not have to log in a password more than once, thereby saving time while on our site. If users reject the cookie, they may still use our site. The only drawback to this is that the user will have to enter ID details repeatedly. 
 
Some of our business partners use cookies on our site (for example, advertisers). However, we have no access to or control over these cookies, once we have given permission for them to set cookies for advertising.
  
Sharing data with third parties
Upon registration with SHIVAI, each of our customers is assigned a random and anonymous customer number, which we use to track customer orders. This customer number is different from any custom login ID selected by you and may be passed to third party vendors with whom we work to provide more efficient and relevant services to our users. Our anonymous customer numbers may be used to measure traffic and visiting patterns on SHIVAI and on other websites on the Internet. We may also compile statistics and other data about our customers on an aggregated basis, and may share such aggregated data with selected third parties. SHIVAI can (and you authorize us to) release any information about you when we believe that such release is reasonably necessary to comply with law, enforce or apply the terms of any of our user agreements, enforce other SHIVAI rights, or protect the rights, property or safety of SHIVAI, the SHIVAI Web site, our users, or others. Further, as permitted by applicable law, SHIVAI can (and you authorize us to) disclose your login ID, name, street, address, city, state, zip code, country, phone number, E-mail, company and any other information in connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity whenever SHIVAI in its sole discretion believes necessary or appropriate. In the event SHIVAI, Inc. goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among assets transferred. You will be notified via E-mail of any such change in ownership or control of your personal information.

In addition, we may share information about you with third parties as necessary to complete a transaction requested by you and we may share information about you with our business partners, affiliates or other third parties with your approval only. If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, or delete it by making the change in My Account located in My Page on SHIVAI.COM, or by contacting our Customer Care department at 1-702-254-3888.

SHIVAI.COM Site member users are protected by the SHIVAI Privacy Policy. Any users who sign up to use the services provided by SHIVAI are requested to read the SHIVAI Privacy policy and User Agreement and to comply by its requirements and restrictions.

All registration data can be updated by users to keep it correct and up to date; all information is stored in a secure environment and accessed only by the SHIVAI Staff for operational use.

INFORMATION USE

*Profile
We store information that we collect through cookies, log files and forms, to create a profile of our users. A profile is stored information that we keep on individual users. Consequently, collected information is tied to the users personally identifiable information to provide offers and improve the content of the site for the user and other users. We do not share your profile with other third parties.

*Log Files
Like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track users movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

Communications from the Site

*Special events and Updates
We send all new members a welcoming E-mail to verify password and username. Established members will occasionally receive information on products, services, special events, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Choice and Opt-out sections. 

*Newsletter
If a user wishes to subscribe to our newsletter, we ask for contact information such as name and E-mail address. Out of respect for our users privacy we provide a way to opt-out of these communications. Please see the members section.

*Service Announcements
On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an E-mail. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.

*Customer Service
We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account we reply via live help, E-mail or phone, in accordance with the users wishes.

*Children's Privacy
This Web site is designed for an adult audience only, and children should not use this Web site. We will not intentionally collect online any personal information (such as a child's name or E-mail address) from children under the age of 13. If you think that we have collected personal information from a child under the age of 13, please contact us and we will address the issue.

*Legal Disclaimer
Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.

*Business Transitions
In the event SHIVAI.COM goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users personal information will, in most instances, be part of the assets transferred. Users will be notified via E-mail and prominent notice on our Web site for 30 days prior to a change of ownership or control of their personal information. If as a result of the business transition, the users personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section.

*Choice/Opt-out
Our users are given the opportunity to opt-out of having their information used for purposes not directly related to our site at the point where we ask for information. For example, our registration form has an opt-out mechanism so users who register, but don’t want any marketing material, can keep their E-mail address off of our lists.  

*Auction Notices
You may choose whether or not to receive Outbid and order processing E-mails in My Account and in My Mailbox. By registering at SHIVAI, you consent to the collection and use of this information by SHIVAI for order processing, Auction Alert E-mails, or the sharing of your personally identifiable information to our business partners (with your consent only). In the event of changes in our privacy policy, this page will be updated with the current information.

Users of our site are always notified when their information is being collected by any outside parties. We do this so our users can make an informed choice as to whether or not they should proceed with services that require an outside party.

This Web site may contain links to other web sites. We provide these links for your convenience, but we do not review, control or monitor the privacy practices of websites operated by others. The requested information typically includes contact information (such as name and address). Contact information will be used and/or shared with the contest survey/sponsors to notify the winners and award prizes.

Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site. Users personally identifiable information is not shared with third parties unless we give prior notice and choice. Though we may use an intermediary to conduct these surveys or contests, they may not use users personally identifiable information for any secondary purposes.

*Protecting your login ID and password
Always keep your SHIVAI account number and password secret. They are your only identification for bidding purposes. If you receive information about a bid you did not place, or questionable communications regarding your account, please contact SHIVAI Customer Support immediately by E-mail or by telephone at 1-702-254-3888. One potential way for someone to steal your login ID and password is if you bookmark any area on MyPage or a bid submission page. This is a concern if your browser is available to other people at work, home, or especially if you use a browser at a public internet café. You should not bookmark such pages and you should clear the browser cache and quit the browser completely when you are done surfing SHIVAI. We have also worked to protect you against such a mistake. Even if someone obtains both your login ID and password, the system is designed to restrict access to your credit card information because that field is cleared when they log in to My Page.

About SSL, security, and firewall problems
Some older browsers (such as IE 3.0.2) have known SSL bugs. These can result in the browser crashing on SSL pages or giving error messages. We recommend that you upgrade to the latest version of whatever browser you prefer. For AOL users, you may be able to upgrade your security by downloading and replacing the schannel.dll from Microsoft. This Web site takes every precaution to protect our users information. When users submit sensitive information via the Web site, their information is protected both online and off-line.

We do everything in our power to protect user-information both off-line and online. All of our users information, is restricted in our offices. Only employees who need the information to perform a specific job are granted access to personally identifiable information.

How your information is encrypted

There are certain areas on the site where you may enter and submit additional information. Because this Website wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance. 

*Tell-A-Friend
If a user elects to use our referral service for informing a friend about our site, we ask them for the friends name and E-mail address. SHIVAI will automatically send the friend a one-time E-mail inviting them to visit the site. SHIVAI stores this information for the sole purpose of sending this one-time E-mail and tracking the success of our referral program.

The friend may contact SHIVAI to request the removal of this information from our database and opt out of receiving any other information and ads via E-mail. To Opt Out Click Here

*Address Verification
We use a number of verification checks (possible requirement of utility bill) to verify a users identity and address to reduce the risk of fraudulent behavior affecting our users. All new users will at some point be verified by our address check and if the user is found to be using false information then his/her account will be terminated after a period of warning and the chance to correct the details.

*Telephone Verifications
In order for this Web site to enhance its ability to verify users the SHIVAI team carries out random number verification checks, this ensures that registered users do not input false details and can be contacted. Telephone conversations may be recorded for training purposes and to improve the quality of the checks.

*Updating/Correcting/Amending/Deleting Personal Information

If a users personally identifiable information changes (such as Postal/Pin/Zip code, Phone number, E-mail, or Postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users personally identifiable information.

*Notification of Changes
If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the privacy policy under which the information was collected.

If, however, we are going to use users personally identifiable information in a manner different from that stated at the time of collection we will notify users via E-mail.
